This privacy policy describes the types of personal information Legacy Plus Foundation (“Legacy Plus”, “we” or “our”) collects and processes from our websites, the Reel Genius platform (including www.reelgenius.com and www.app.reelgenius.com), mobile applications, and through other interfaces with and aspects of Legacy Plus’s business (collectively, “Services”). We value your privacy and make this policy easily available throughout our Services to assist you in understanding the handling of information in the course of using the Services.  By using the Services or voluntarily providing personal information to us, you consent to the terms of this privacy policy.  If you do not agree to the policy, please do not use the Services.

1.  Collection of Personal Information

Information You Give to Us

We may collect any information, including your first and last name, email address, mailing address, telephone number, username and password, business title (for example, if you are a teacher), school affiliation, and other information that you provide when you interact with us.  Some examples are when you:

  • Access, use, or interact with the Services;
  • Engage in conversation with our AI-based chatbot educational assistant;  
  • Sign up to receive email communications from us;
  • Register or create an account on the Reel Genius platform;
  • Correspond or communicate with us by phone, e-mail or otherwise;
  • Register, enroll or participate in any surveys, questionnaires, promotions, or any other services offered in connection with the Services;
  • Use social media to interact with us

Information Collected Automatically

Each time you use the Services, we may automatically collect certain types of information. Some examples of automatic information we may collect are as follows:

  • Your IP address, MAC address, browser type, operating system, device-identifying information, type of computer, and type of Web browser software, the specific webpages visited during your connection, and the domain name from which you accessed the Services.  
  • Information about your browsing behavior, such as the date and time you interact with the Services, the areas or pages of the Services that you visit, the amount of time you spend viewing or using the Services, the number of times you return to the Services and other clickstream data.
  • We may use “cookies” of different types to recognize your computer or device.  A cookie is a small text file that a website, online application, or any other digital service may save to your internet browser and/or your device for use in subsequent visits to the Services or other sites.

We may use web beacons, scripts, pixel tags, clear GIFs or similar technologies that allow us to know if content within our Services has been accessed, whether an email has been opened, or whether links in an email have been clicked.  In some instances, these technologies may allow us to associate activities with particular users.

We may combine the information we collect through cookies, web beacons, or other technology tools with other information we have collected from you or information from other sources.  

2.  Use of Personal Data Collected

We may use information about you for purposes described in this privacy policy or disclosed to you in the Services.  For example, we may use information about you:  

  • For the purposes for which you provided the information (for example, lesson tracking);
  • For editorial and feedback purposes;
  • For marketing and promotional purposes;
  • To develop new programs and outreach opportunities;
  • For content improvement and research;
  • To customize the content and layout of the Services;
  • To notify you about updates to the Services;
  • To Respond to your inquiries; or
  • To take other actions in response to your inquiries or other activities related to the Services.

We also may aggregate personal information use such information to analyze the effectiveness of our Services, improve our Services, conduct research and for other related purposes.  

3.  Sharing or Disclosure of Your Personal Data

Unless otherwise agreed, we will not sell or disclose to third parties any individually identifying information, such as names, e-mail addresses, telephone numbers, and other personal information which users voluntarily provide to us, except as follows:

  • If a Student Account is linked with an Educator, that Educator may have access to certain information, such as full name, account profile details, information related to assignments and quizzes, engagement metrics, and last login dates;
  • We disclose information to employees, vendors, and outside service providers who need access to such information to carry out work or perform services on our behalf, such as to facilitate the overall operation of the Services, and to perform functions on our behalf, such as monitoring visitors to the Services, sending emails and promotional offers, analyzing data, processing credit card payments, providing customer service, provide artificial intelligence (“AI”) tools (“AI Tool Provider”).  These third-party service providers are prohibited from using personal information for any other purpose and are contractually required to comply with all applicable laws and requirements;
  • To the extent necessary to comply with applicable laws or valid legal processes, such as in response to subpoenas or court orders.
  • To protect the rights and intellectual property of Legacy Plus.
  • To investigate, prevent or take action regarding illegal activities, suspected fraud, violations of our policies, or as otherwise required by law.
  • In urgent circumstances, to protect Legacy Plus or the personal safety of any individual.  

4.  Cookies Policy

The Services may use “cookies” and related technologies, such as web beacons, pixels, local storage, and software development kits (SDKs), to collect and store information about your use of our Services (collectively, “cookies”). Cookies are small pieces of information stored by your browser or other application on your computer's browser or hard drive.  Cookies are used to connect your computer, tablet, or mobile device, with information stored about your activity, searches and preferences across our Services, both within a single session and across multiple sessions.  Some examples of this data include your account preferences, user specific information on pages accessed, searched terms or addresses entered, and previous interactions with the Services.  We use both session ID cookies and persistent cookies. A session cookie expires when your browser is closed, and a persistent cookie may stay on your hard drive for an extended period. Session cookies make it easier for you to navigate our Services; persistent cookies can perform such activities as storing your password so you do not have to sign in every time you visit, and/or may be used to enable us to track and target the interests of our users so as to enhance the overall experience of using our Services.

The “help” portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive new cookies or how to disable cookies altogether.  If you reject cookies, you may not be able to participate in certain activities or receive a promotion tailored to you.  The Services do not control and do not guarantee the effectiveness of browser-based tools for managing cookies.  For mobile applications, you should review the device’s settings and select the option that allows you to disable tracking or personalization. Typically, to opt out using system settings, such devices require you to select options like “ask app not to track” or “delete advertising ID.” These settings vary by device type.

5.  Links to Other Websites

Our Services may contain links to other sites that are not controlled in any way by us. Please be aware of this when you click on any such links; we are not responsible for the privacy practices and/or policies of any website other than our own. Consequently, we strongly suggest that you review the privacy policy of every website you visit, whether or not they are linked to by our own site.

6.  Data Security and Retention

We use industry-standard techniques to help to protect any personal information you have provided to us from loss, misuse or alteration. However, please be aware that no method of electronic storage can ever be 100% secure. Therefore, as is the case with any organization - we are not in a position to guarantee the absolute security of your information.  In this regard, we urge you to take every precaution to protect your personal data while you are on the Internet. At a minimum, we encourage you to make sure that you are using a secure browser as you surf the Internet. School districts can request a deletion of any data retained by contacting us at hello@reelgenius.com or by calling 1-877-933-4407, including at the end of the contract term.  

7.  Social Media

We maintain a social media presence, such as a Facebook page, an Instagram page, and a Twitter feed. You can interact with us through social media, such as by entering our contests, posting content, sharing material from our Site, and using our social media plug-ins. When you interact with us using social media, we may receive information such as your user ID, your profile picture, photos you post, and similar information, which is often determined by your privacy settings at social media sites. We may use the information for the same types of purposes we describe throughout this privacy policy. Your use of social media sites is primarily governed by the site operators’ privacy policies and terms of service, and the information you share with us and with others is largely controlled by the privacy settings you have established at those sites.

8. Children’s Privacy

COPPA  

Legacy Plus is committed to protecting the privacy of children. This Children’s Online Privacy Policy explains our information collection, disclosure, and parental consent practices with respect to information provided online by children under the age of 13 (“children”). This policy is in accordance with the U.S. Children’s Online Privacy Protection Act (“COPPA”) and outlines our practices in the United States regarding children’s online personal information. Parents and guardians are collectively referred to herein as “parents.”  

K-12/School Use

In the course of providing our Services, we collect certain information from children for lesson tracking, notification, and security purposes, including a parent’s contact information, such as an email address, and the child’s first name, phone number, school affiliations, account username, and password. Please note that children can choose whether to share their information with us, but certain features cannot function without it. As a result, children may not be able to access certain features if required information has not been provided. We will not require a child to provide more information than is reasonably necessary in order to participate in an online activity. This information will not be shared with others or be publicly available.  

Consistent with the requirements of COPPA, on any child-targeted website or app, or in any instance where we ask for age and determine that the registered user is under the age of 13, we will ask for a parent’s email address, or other contact information, before we collect any personal information from the child in order to obtain verifiable parental consent. If you believe your child is participating in an online activity that collects personal information and you or another parent has not received an email or message providing notice or seeking your consent, please feel free to contact us at hello@reelgenius.com. We will not use contact information obtained for parental consent purposes to advertise to the parent.

Parental Consent  

In the event Legacy Plus wishes to collect online personal information from a child, COPPA requires that we first seek a parent’s consent by email. In the email, we will explain what information we are collecting, how we plan to use it, how the parent can provide consent, and how the parent can revoke consent. If we do not receive parental consent within a reasonable time, we will delete the parent’s contact information and any other information collected from the child in connection with that activity.

Data Use Commitments

We will only use this children’s data for the express purpose for which it was provided. The personal information will not be used for any other purpose. Children’s data is not sold, used for targeted or behavioral advertising, or used to build profiles unrelated to the educational purposes disclosed to you.    

Parental Control  

At any time, a parent can refuse to permit us to collect further personal information from their children in association with a child’s account and can review or have deleted from our records a child’s personal information. Please contact us to request to review, change, or delete your child’s personal information by sending an email to hello@reelgenius.com. Please include the child’s username, if applicable, and the parent’s email address and telephone number in your request. To protect children’s privacy and security, we will take reasonable steps to verify a parent’s identity before granting access to any personal information.

Please keep in mind that a request to delete records may lead to the termination of an account, membership, or other service.

9.  Do Not Track

Do Not Track (“DNT”) is a privacy preference that users can set in some web browsers, allowing users to opt out of tracking by websites and online services. At the present time, the World Wide Web Consortium (W3C) has not yet established universal standards for recognizable DNT signals and therefore, Legacy Plus and the Services do not recognize DNT.

10.  Your California Privacy Rights

California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us, once a calendar year, information about the user information we shared with third parties for their own direct marketing purposes, including the categories of information and the names and addresses of those businesses with which we have shared such information.  As discussed elsewhere in this privacy policy, we do not currently share the personal information of California residents with third parties for their own direct marketing purposes.  However, if you have further questions about our privacy practices and compliance with California law, please contact us as explained below.

11.  Changes to Privacy Policy

We may change this privacy policy from time to time, including as required to keep current with rules and regulations, new technologies and security standards. When we do, we will post the change(s) on our website. If we change the policy in a material and retroactive manner, we will provide appropriate notice to you.
